Under chapter IV of the Indian Emigration Act, 1983 by use of a permit a foreign employer may undertake direct recruitment of Indian personnel. For application purposes with regards to this, applications can be submitted to the local or nearest Indian mission or to the office protector general of emigrants, Ministry of Overseas Indian Affairs, Akbar Bhavan, Chankyapuri, New Delhi in form VI along with the documents/ information mentioned therein. In addition the foreign employer will deposit a bank guarantee of US$ 2,500 with the Indian mission before a permit is issued. The bank guarantee will released to the foreign employer after the mission has ascertained that the contract period is over and all the worker’s dues have been paid by the employer.
A foreign employer will also be required to provide bank guarantee of ten thousand rupees for each person intended to be recruited subject to minimum of one Lakh rupees and a maximum of twenty Lakh rupees which is valid for a period of one year and above the duration of the employment contract.
